The Click-to-Accept License provides a framework for establishing licensing terms between vendor and customer without signatures to a written agreement. The initial summary of terms establishes that clicking the "ACCEPT" button establishes privity of contract between the parties and renders the terms of the Agreement enforceable. The version of the Agreement provided hereunder envisions a feature rich and complex application software system that is installed by customer who must acknowledge the terms of the license as part of the installation routine. Failure to acknowledge the terms of the license precludes the download option. The price of the software is set forth in a separately maintained price schedule.
