Form Overview
The Construction Agreement for new construction engages a contractor to construct an office building on a parcel owned by the engaging party. The building and its construction is subject to plans which have already been prepared at the time of the engagement. Such architect plans and specifications are incorporated into the Agreement by Exhibit (not included). The Agreement also incorporates the Proposal submitted by Contractor (not included). Payment of the agreed price is by loan draws in accordance with the terms of the applicable construction loan. Change Orders must be in writing and may result in price increases. Contractor agrees that it will protect the property from liens. Disbursement of final sums is subject to receipt of a Certificate of Occupancy.
