The Leasing Agent Deposit Agreement is a Leasing Agent brokerage agreement under which payment of the Brokerage Fee is advanced or a deposit and retention of the fee by the Leasing Agent is contingent upon signing of a Lease Agreement by Client on or before a certain date. The fee is refundable if the contingency does not occur. The contingency is the signing of a Lease Agreement, at which time any remainder of the Broker Fee exceeding the amount of the deposit will be paid by Client to Broker.
