Arbitrator selection for your dispute should focus on three basic criteria. The most important factor to consider is the experience of the Arbitrator in the technology industry. Business and contract disputes in the technology industry are often best handled by lawyers who have represented technology companies and, therefore, have an appreciation of standard industry practices. Alternatively, patent disputes are sometimes best handled by Arbitrators with science or engineering backgrounds.

A second important criteria focuses on the philosophy of the Arbitrator in processing the case. Some Arbitrators are liberal in applying rules, preferring to give both parties every opportunity to make their case. Other Arbitrators are more strict about procedures and process, preferring to keep processing costs low and orchestrate a final resolution in an abbreviated amount of time. The best balance between these two competing pressures will depend upon your case.

Finally, costs and availability are a factor. Higher profile Arbitrators with full schedules tend to be more costly than some of their equally qualified counterparts. The best Arbitrator in this context will depend upon the complexity of your case and budget.
